These Terms and Conditions govern your use of www.jennifermehling.com, including its associated pages, online shop, email sign-up forms, artwork purchases, custom commissions, memberships, workshop registrations, Blooms by Jesus offerings, and other products or services offered through the website.

Throughout these Terms, “we,” “us,” and “our” refer to Jennifer Mehling. “You” refers to any website visitor, customer, purchaser, participant, subscriber, member, or user of this website.

By accessing this website, purchasing a product, registering for an event, enrolling in a membership, or using any part of the website, you agree to these Terms and Conditions. Please discontinue use of the website if you do not agree to them.

2. Website Use

You may use this website only for lawful, personal, and noncommercial purposes, except as expressly authorized in writing.

You agree not to:

• Copy, reproduce, distribute, sell, or exploit website content without written permission.

• Use photographs or images of artwork to create prints, products, digital files, artificial-intelligence training materials, derivative artwork, or commercial content without authorization.

• Attempt to interfere with the website's security or operation.

• Submit fraudulent orders, registrations, or payment information.

• Misrepresent your identity or affiliation with another person or organization.

• Use the website in a manner that violates applicable law or infringes another person's rights.

We reserve the right to restrict or terminate access to the website when misuse is suspected.

3. Products and Availability

We make reasonable efforts to describe and photograph products accurately. However, colors and details may appear differently depending on your screen, device settings, lighting, or display.

Original artwork is one of a kind unless otherwise stated. Adding an item to a cart does not reserve it. A product is not considered purchased until payment has been successfully completed.

Products, collections, pricing, availability, descriptions, promotions, and release dates may be changed or discontinued without notice, subject to applicable law and existing purchase agreements.

If an item is mistakenly sold more than once, listed at an incorrect price, damaged before shipment, or otherwise unavailable, we may cancel the order and issue a refund.

4. Pricing and Payment

Prices are displayed in United States dollars unless otherwise stated.

Applicable sales tax, shipping, handling, insurance, and other charges may be added at checkout.

Payment is processed by third-party payment providers available through Squarespace or other authorized platforms. We do not directly store complete payment-card information.

You represent that:

• The payment information you provide is accurate.

• You are authorized to use the selected payment method.

• You authorize us and our payment processor to charge the agreed purchase or subscription amount.

We reserve the right to refuse or cancel an order when fraud, unauthorized activity, pricing errors, inventory errors, or other irregularities are suspected.

Custom Commission Payments: Custom fine art commissions require a 50% deposit upon acceptance, with the remaining balance due before shipping or pickup. Commission pricing, payment terms, and additional charges will be confirmed in writing before payment is collected. Please refer to Section 9.

Recurring Membership Payments: Subscription-based products and memberships may involve automatically recurring charges. The applicable price, billing frequency, renewal terms, and cancellation instructions will be disclosed before enrollment. Please refer to Sections 10 and 11.

5. Order Acceptance

An order confirmation acknowledges that we received your order. It does not necessarily constitute final acceptance.

We may contact you for additional information before fulfilling an order. We may limit quantities or decline transactions that appear fraudulent, made for unauthorized resale, or inconsistent with these Terms.

6. Shipping, Returns, and Damaged Orders

Purchases are subject to our separate Shipping & Returns Policy, which is incorporated into these Terms.

Processing and delivery dates are estimates and are not guaranteed unless explicitly agreed to in writing.

Customers are responsible for providing a complete and correct shipping address. Additional costs caused by an incorrect or incomplete address may be charged to the customer.

7. Original Artwork and Artist Reproduction Rights

Original artwork is sold as a unique physical object. Purchasing original artwork transfers ownership of the physical piece only.

All copyrights, reproduction rights, licensing rights, publishing rights, commercial-use rights, and other intellectual-property rights remain exclusively with Jennifer Mehling unless expressly transferred through a separate signed written agreement.

Jennifer Mehling expressly reserves the right, at any time and without additional permission from or notice to the purchaser, to photograph, reproduce, publish, display, distribute, license, sublicense, adapt, or commercially use images of original artwork, including artwork that has already been sold.

These rights include, but are not limited to:

• Fine art prints and reproductions

• Open-edition and limited-edition prints

• Books, publications, and printed materials

• Licensing and wholesale partnerships

• Textiles, apparel, accessories, and home goods

• Stationery, greeting cards, and gift products

• Digital products and promotional materials

• Social media, advertising, and marketing

• Portfolios, websites, and exhibitions

• Educational materials and creative resources

• Future collections, collaborations, and commercial products

The purchase of an original painting does not guarantee that its image will remain exclusive to the purchaser or that reproductions will not be created or sold in the future.

The artist may determine whether, when, where, and how artwork is reproduced, licensed, or used commercially without notifying the owner of the physical original.

These rights also apply to commissioned artwork unless a separate signed written agreement expressly provides otherwise. Use of client-supplied photographs or other third-party materials remains subject to applicable rights and permissions.

Natural variations, visible brushwork, texture, layering, markings, irregular edges, gold details, and other handmade characteristics are part of the artwork and are not considered defects.

8. Prints, Reproductions, and Home Goods

Colors, placement, cropping, scale, and texture may vary slightly between an original artwork and a reproduction or product containing that artwork.

Print editions will be identified as open edition, limited edition, signed, unsigned, or embellished when applicable.

Customers may not scan, reproduce, alter, or commercially exploit the artwork appearing on a purchased product without written permission.

The lawful resale of an original physical product does not include the right to reproduce or license the image.

The artist reserves the right to introduce additional products, editions, formats, or licensed merchandise featuring her artwork, subject to any specific written exclusivity commitments.

9. Commissions and Custom Products

Custom original artwork, personalized products, and commissioned pieces are created specifically for each client and may be subject to a separate written commission agreement.

Commission Acceptance and Payment

• A 50% nonrefundable deposit is required to secure an accepted commission and reserve studio time, subject to applicable law and the agreed commission terms.

• The remaining 50% balance is due upon completion, before artwork is shipped or released for local pickup.

• A commission is officially booked only after the project details, total price, payment schedule, and estimated timeline have been agreed upon in writing and the required deposit has been received.

• Submitting a commission inquiry does not guarantee acceptance or reserve a place on the artist's schedule.

Commission Timeline

• Custom fine art commissions typically require 4–6 weeks from acceptance and receipt of the required deposit.

• Completion dates are estimates unless a specific deadline is agreed upon in writing.

• Rush commissions may be accepted at the artist's discretion and may incur additional fees, which will be disclosed and agreed upon before work begins.

• Shipping and delivery transit times are additional.

Artistic Interpretation

All commissioned artwork is created in Jennifer Mehling's individual artistic style.

Clients may provide reference photographs, preferred colors, inspiration, and meaningful details. However, artistic decisions, composition, brushwork, and creative interpretation remain at the artist's discretion.

Minor variations from reference images, sketches, digital previews, or color preferences are expected and do not constitute defects.

Changes and Revisions

Any requested changes to an approved commission may result in additional charges or an extended completion timeline. Significant changes to the original project scope require mutual written agreement.

Cancellations and Refunds

Because custom artwork is created specifically for each client, the agreed deposit is nonrefundable once the commission is accepted and payment is received, subject to applicable law.

If a client cancels after work has begun, any additional charges or refunds will be determined according to the written commission agreement and the work completed.

If Jennifer Mehling is unable to fulfill an accepted commission, payments received for unfulfilled work will be refunded unless another resolution is mutually agreed upon.

Custom commissioned artwork is generally final sale, except in cases of shipping damage, material differences from the written agreement, or where otherwise required by law.

Copyright and Reproduction Rights

Purchase of commissioned artwork transfers ownership of the physical artwork only.

Jennifer Mehling retains all copyright, reproduction, licensing, publishing, and commercial-use rights to commissioned artwork unless expressly transferred through a separate signed written agreement.

The artist may reproduce, license, publish, or commercially use the commissioned artwork at any time without additional notice or permission, subject to any written confidentiality agreement, third-party rights, and applicable law.

Shipping and Delivery

Custom artwork will be carefully packaged for shipping or prepared for arranged local pickup. Shipping costs, where applicable, will be communicated before final payment.

10. The Made for More Print Club

The Made for More Print Club is a monthly fine art subscription offered by Jennifer Mehling Fine Art.

Membership and Billing

The standard Print Club membership is $18 per month unless otherwise stated at enrollment.

By subscribing, members authorize recurring monthly charges through the selected payment provider until the subscription is canceled.

The applicable billing date, renewal frequency, shipping charges, and cancellation instructions will be disclosed during enrollment.

Monthly Artwork

Each month, Jennifer Mehling creates an original painting specifically for the Print Club collection.

Members receive an exclusive fine art print from the featured monthly collection.

Print Club artwork is created for members, but membership does not transfer copyright, reproduction rights, licensing rights, or ownership of the original painting.

Jennifer Mehling retains all intellectual-property rights to the artwork, subject to any specific written commitments concerning Print Club exclusivity.

Shipping and Delivery

Monthly prints are generally scheduled to ship between the 10th and 15th of each month.

Members should enroll during the preceding month to receive the following month's print, subject to the enrollment deadline stated at signup.

Shipping schedules are estimates and may be affected by production delays, holidays, or postal-service interruptions.

Members are responsible for maintaining an accurate shipping address.

Original Artwork Drawing

Print Club members may have an opportunity to win the original artwork featured in a monthly collection.

Each drawing will be governed by separate official rules specifying eligibility, entry methods, deadlines, prize details, winner selection, and fulfillment.

Where required by law, a free alternative method of entry will be available, and purchasing a membership will not improve the odds of winning.

Cancellation and Renewal

Members may cancel future renewals using the cancellation method provided during enrollment or by contacting Jennifer Mehling Fine Art.

Cancellation prevents future recurring charges once processed according to the disclosed cancellation terms.

Amounts already charged are not automatically refunded, except as required by law or expressly stated in the applicable membership offer.

Membership Changes

Jennifer Mehling Fine Art reserves the right to modify, suspend, or discontinue the Print Club, subject to existing membership commitments and applicable law.

Material changes to pricing, benefits, or renewal terms will be communicated in advance when required.

11. Blooms by Jesus Online Community

Blooms by Jesus is a faith-centered creative community designed to encourage spiritual growth, creativity, connection, and intentional living.

Online membership offerings may include community discussions, creative worship experiences, devotionals, guided activities, live gatherings, educational resources, and other faith-based content.

Specific benefits and features will be described on the applicable membership enrollment page.

Membership and Billing

Paid community memberships may be offered through recurring monthly or other subscription plans.

Membership pricing, billing frequency, minimum commitments, renewal terms, and cancellation instructions will be disclosed before payment.

Any founding-member pricing or promotional membership arrangement will be subject to the written terms presented at enrollment.

By enrolling in a recurring paid membership, members authorize the applicable recurring charges until cancellation or expiration according to the disclosed membership terms.

Founding Member Commitment and Pricing

Founding Members agree to a minimum 90-day paid membership commitment beginning on their enrollment date. After the initial 90-day commitment, membership will continue on a month-to-month basis until canceled.

The Founding Member rate is reserved for members who maintain an active, uninterrupted subscription. If a Founding Member cancels their membership, they forfeit their exclusive Founding Member rate and are not guaranteed the opportunity to regain that pricing if they choose to rejoin in the future.

All membership charges, renewal terms, and cancellation procedures will be clearly disclosed at enrollment.

Community Participation

Members agree to participate respectfully and constructively.

Harassment, threats, discrimination, exploitation, abusive conduct, unauthorized solicitation, and behavior that substantially disrupts the community are prohibited.

Blooms by Jesus reserves the right to moderate discussions, remove inappropriate content, or suspend or terminate participation when reasonably necessary to protect the community, subject to applicable law and refund obligations.

Faith-Based and Educational Nature

Blooms by Jesus is a Christian, faith-centered creative community.

Content may include biblical teaching, prayer, testimony, creative exercises, reflection, and discussions concerning personal and spiritual growth.

Participation is voluntary.

Blooms by Jesus does not provide licensed psychotherapy, professional counseling, medical treatment, crisis intervention, or art therapy.

Content and activities are intended for spiritual encouragement, creative expression, and general educational purposes and are not substitutes for professional healthcare or mental-health services.

Member Privacy and Confidentiality

Members are expected to respect the privacy of others.

Personal stories, photographs, prayer requests, and sensitive information shared within private community spaces should not be copied, recorded, published, or distributed outside the community without appropriate permission.

Although reasonable community expectations and moderation practices may be established, complete confidentiality among members cannot be guaranteed.

Community Content and Copyright

All original teaching materials, artwork, devotionals, recordings, creative prompts, videos, designs, and other content provided by Jennifer Mehling or Blooms by Jesus remain the intellectual property of their respective owners.

Membership grants a limited, personal, nontransferable right to access and use the materials for their intended purposes during the membership period.

Members may not reproduce, distribute, resell, license, or commercially exploit community materials without written authorization.

Members retain ownership of original content they create and share, subject to the limited permissions reasonably necessary to display that content within the community.

Original Music and Audio Content

All original music, musical compositions, lyrics, melodies, arrangements, sound recordings, podcast introductions, and other original audio content created and owned by Jennifer Mehling remain her intellectual property.

Jennifer Mehling reserves all applicable copyright, reproduction, distribution, licensing, synchronization, and commercial-use rights to these works. No purchase, membership, event registration, or access to content grants permission to copy, download for redistribution, reproduce, remix, sample, distribute, license, or commercially use the music or recordings without prior written authorization.

Jennifer Mehling reserves the right to release, publish, distribute, license, or commercially use her original music and recordings at any time without prior notice, subject to applicable law and any existing third-party agreements.

Cancellation and Access

Members may cancel according to the terms disclosed at enrollment.

Cancellation generally ends future recurring charges but does not automatically refund previously paid membership fees, except where required by law or stated in the membership offer.

Access to paid community materials and features may end when the paid membership period expires.

Program Changes

Blooms by Jesus reserves the right to modify community features, schedules, content, and offerings as the ministry and community develop.

Material changes to paid membership benefits or pricing will be communicated in advance when required by law or the applicable membership agreement.

12. Workshops, Gatherings, and Events

Registrations for workshops, painting experiences, Blooms by Jesus gatherings, retreats, or other events are subject to our separate Workshop & Event Policy, which is incorporated into these Terms.

Blooms by Jesus gatherings are faith-centered creative worship experiences. Unless a particular event expressly states otherwise, they are not:

• Licensed counseling

• Medical or mental-health treatment

• Art therapy

• Crisis care

• Pastoral counseling

• A substitute for professional healthcare

Participation is voluntary, and participants are responsible for deciding whether an activity is appropriate for them.

13. Educational and Inspirational Content

Website articles, emails, devotionals, videos, creative prompts, interviews, social-media content, and other materials are offered for general educational, artistic, inspirational, and faith-based purposes.

They are not a substitute for legal, medical, financial, mental-health, or other licensed professional advice.

Any personal testimony, spiritual reflection, or creative practice shared represents personal experience and belief. Individual outcomes may vary.

14. Email Communications

When you subscribe to an email list, register for an event, place an order, or request information, you may receive transactional communications related to your activity.

Marketing emails will include an unsubscribe option. You may unsubscribe from promotional emails at any time.

You may still receive necessary transactional messages, such as order confirmations, workshop information, receipts, membership notifications, or responses to your inquiries.

Enrollment in one mailing list does not automatically constitute consent to receive unrelated marketing communications unless that consent has been clearly obtained.

15. Testimonials and User-Submitted Content

When you voluntarily submit a testimonial, review, photograph, comment, or other content, you represent that:

• The content is truthful.

• You have the right to share it.

• It does not infringe another person's rights.

• It does not contain unlawful, abusive, or misleading material.

We will request permission before intentionally using a customer's identifiable photograph or detailed testimonial in prominent promotional materials unless the content was submitted through a form that clearly provided such permission.

You may revoke permission for future promotional use by contacting us. Revocation will not necessarily require recall of materials already lawfully printed or distributed.

16. Intellectual Property

All original artwork, photographs, paintings, illustrations, graphics, logos, collection names, workshop materials, videos, written content, devotionals, course materials, product designs, and other creative materials appearing on this website are owned by Jennifer Mehling or used with permission.

They are protected by applicable United States and international copyright, trademark, and other intellectual-property laws.

No content may be copied, reproduced, downloaded for unauthorized redistribution, printed for commercial purposes, republished, distributed, modified, displayed commercially, licensed, used to train an artificial-intelligence system, or otherwise commercially exploited without prior written authorization.

Jennifer Mehling expressly reserves all rights to reproduce, license, publish, adapt, distribute, and commercially use her original artwork, including previously sold and commissioned works, at any time without notifying or obtaining permission from purchasers, except where a separate signed agreement or applicable law provides otherwise.

Purchasing a physical or digital product does not transfer intellectual-property rights unless a separate signed agreement expressly states otherwise.

17. Trademarks and Brand Names

Jennifer Mehling, Blooms by Jesus, Let Jesus Make Your Life a Garden, The Made for More Shop, related logos, program titles, collection titles, slogans, and brand elements may not be used in a way that suggests endorsement, partnership, sponsorship, or affiliation without written permission.

This provision applies whether or not a particular name or logo has been federally registered.

18. Third-Party Services and Links

This website may use or link to third-party services, including Squarespace, payment processors, shipping carriers, social-media platforms, video platforms, analytics providers, email providers, registration systems, community platforms, and embedded content.

We do not control third-party websites, privacy practices, availability, security, or content.

Your use of those services may be governed by their own terms and policies.

A link or reference does not necessarily constitute endorsement.

19. Website Availability

We aim to keep the website available and accurate, but we do not guarantee uninterrupted access, error-free operation, or compatibility with every device or browser.

We may suspend, modify, remove, or discontinue website features, subject to applicable law and existing paid-service obligations.

20. Disclaimer of Warranties

To the fullest extent permitted by law, the website, content, products, and services are provided on an “as is” and “as available” basis.

We make no guarantee that:

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect.

26. Entire Agreement

These Terms, together with the Privacy & Cookies Policy, Shipping & Returns Policy, Workshop & Event Policy, applicable membership disclosures, official promotion rules, and any applicable written product or commission agreement, constitute the agreement between you and us regarding use of the website and applicable purchases or services.

Where a separate signed agreement expressly provides different terms for a particular commission, license, or service, that agreement will control for the matters it specifically addresses.
